End User License Agreement

Effective date: July 8, 2026

This End User License Agreement ("EULA") governs your use of the TapClaim iOS application (the "App"), published by TapClaim ("we", "us"). It works together with our Terms of Service, which describe the service itself in detail, and our Privacy Policy, which describes how we handle your data. TapClaim is not a law firm and does not provide legal advice. Nothing in the App is legal advice, and using TapClaim does not create an attorney-client relationship. TapClaim helps you discover class-action settlements you may qualify for and track claims you have filed. When you file a claim, you submit it yourself on the settlement administrator's official website — TapClaim does not file claims on your behalf, is not a party to any settlement, and does not guarantee eligibility, claim approval, payment amounts, or payment timing.

1. This Agreement Is with TapClaim, Not Apple

This EULA is concluded between you and TapClaim only — not with Apple Inc. or its subsidiaries ("Apple"). TapClaim, not Apple, is solely responsible for the App and its content. Your use of the App must also comply with the Apple Media Services Terms and Conditions (the "App Store Terms").

2. License

We grant you a limited, non-exclusive, non-transferable license to download and use the App for your personal, non-commercial use on Apple-branded devices that you own or control, as permitted by the usage rules in the App Store Terms. The App is licensed to you, not sold. We and our licensors keep all rights not expressly granted in this EULA, including all intellectual property rights in the App.

Parts of the App require an auto-renewing subscription (a weekly plan or an annual plan) purchased as an in-app purchase through the Apple App Store. Payment is charged to your Apple ID, subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period, you manage or cancel your subscription in your App Store account settings, prices are shown in the App before you purchase, and refunds are handled by Apple, not by us. Full subscription terms — including that you can always file any settlement claim for free directly on the administrator's official website without TapClaim — are in the Terms of Service.

5. Maintenance and Support

TapClaim alone is responsible for providing any maintenance and support for the App. You can reach us at info@ever-code.net. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.

6. Warranty

The App is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by applicable law. Settlement information in the App is aggregated from publicly available sources, may contain errors or be out of date, and does not cover every settlement; deadlines and terms are set by courts and settlement administrators and can change at any time. Always verify details on the official settlement website before filing. Payment figures shown in the App are "up to" estimates, and payout timing is an estimate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPCLAIM DOES NOT WARRANT OR GUARANTEE THAT ANY SETTLEMENT WILL BE AVAILABLE OR LISTED, THAT YOU ARE ELIGIBLE FOR ANY SETTLEMENT, OR THAT ANY CLAIM WILL BE ACCEPTED, APPROVED, PAID, PAID IN ANY PARTICULAR AMOUNT, OR PAID AT ANY PARTICULAR TIME. ELIGIBILITY AND PAYMENTS ARE DETERMINED SOLELY BY SETTLEMENT ADMINISTRATORS AND COURTS, NOT BY TAPCLAIM.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are TapClaim's sole responsibility.

7. Product Claims

TapClaim, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. Nothing in this EULA limits TapClaim's liability beyond what applicable law permits.

8. Intellectual Property Claims

If a third party claims that the App, or your possession and use of the App, infringes that third party's intellectual property rights, TapClaim — not Apple — is solely responsible for the investigation, defense, settlement, and discharge of that claim.

9. Legal Compliance

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Terms

You must comply with any applicable third-party terms of agreement when using the App — for example, your wireless carrier's data agreement. Settlement administrator websites opened in the App's in-app browser are operated by third parties and are governed by their own terms and privacy policies, which we do not control or endorse.

11. Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

12. Termination

This EULA is effective until terminated. It terminates automatically if you fail to comply with its terms. You may terminate it at any time by deleting the App and, if you wish, deleting your data as described in the Privacy Policy. On termination, you must stop using the App; sections that by their nature should survive (including Sections 6–8 and 13) survive termination. Terminating this EULA does not by itself cancel an active subscription — manage subscriptions in your App Store account settings.

13. Governing Law

This EULA is governed by the laws of the Republic of Türkiye. Disputes will be resolved in the courts of Istanbul, Türkiye, except that you keep any mandatory rights and venue protections granted by the consumer-protection laws of the place where you live.
